Q: Can I sell the house?

A: Yes, once the house is in your possession you may sell it if you choose to do so.

Q: Do I have to pay taxes on the house before taking possession?

A: Yes, a tax of 24% of the value of the house will be collected by NeighborWorks for the IRS. Any additional taxes owed is determined based on the winner's annual income.

Q: How much will the taxes on the house be?

A: We are required to collect 24% of the value of the house to send to the IRS. This is approximately $87,600. This number may differ based on your income or other tax factors upon your annual tax filing. 24% is what we must collect upon transferring possession of the house.

Q: Are there income limits to win?

A: No, there is no restriction on income to win the house.

Q: Can I use the house as a rental?

A: Yes, once you take possession of the house, it is your choice what to do with it.

Q: What costs initially, is the winner responsible for?

A: Taxes and closing costs, which vary based on winner's income.

Q: How many tickets can I buy?

A: Raffle tickets are limited to a maximum of 50 tickets per entity and are limited to a maximum of 1 ticket per day, if an entity wishes to purchase 50 tickets in total, they must begin purchasing no later than 8/7/2022.

Q: How many tickets are being sold?

A: Total number of raffle tickets available to be sold will be limited to 5,000.

Q: When do tickets stop being sold?

A: Ticket sales will stop on Sunday, September 25, 2022, at 11:59pm

Q: How long does it take to get possession of the home?

A:  NeighborWorks Southern Colorado is required to collect taxes in the amount of 24% of the value of the house upon transfer of ownership. Any other taxes due would be paid by you at the time of your regular annual tax filing.

Q: Can I use my payment information to purchase a ticket for someone else?

A: Yes, you may use the same payment information to purchase multiple tickets, if the name and contact information is different for each ticket purchased in the same day.

NeighborWorks Southern Colorado will raffle off this brand new home located in Hyde Park Gardens at 2407 W. 19th Street, Pueblo, CO 81003 at our 45th Anniversary Sapphire Celebration which will take place at the Pueblo Convention Center on Friday, September 30th, 2022 with the raffle drawing to take place around 8pm. Ticket sales will end on Sunday, September 25th 2022 at 11:59pm.

The home has been utilized as the model home for the Hyde Park Gardens neighborhood on Pueblo's Westside - located just down the street from Dolores Huerta Preparatory High School (DHPH). Upon completion of purchasing your ticket you will receive an email notification that will provide you with a unique ticket number that will be entered into the drawing. Each valid ticket number will be physically entered into a raffle drum until the drawing. Ticket holders need not be present to win.

TERMS & CONDITIONS

NEIGHBORWORKS SOUTHERN COLORADO HOME RAFFLE TERMS & CONDITIONS

A.     SPONSOR.  Thank you for supporting the NeighborWorks Southern Colorado Home Raffle (the “Raffle”), which is being sponsored and conducted by NeighborWorks Southern Colorado, Inc. a non-profit Colorado corporation, 1241 East Routt Ave, Pueblo, CO 81004 (“NWSoCO”). Your purchase of one or more raffle ticket(s) signifies your unconditional agreement to the following Terms & Conditions. In the event of any dispute, a reasonable interpretation or determination by NWSoCO regarding the interpretation and application of these Terms & Conditions shall be final and binding in all matters related to the Raffle.

B.      ADVISEMENTS. This Raffle is subject to all applicable federal, state, and local laws, regulations, and ordinances, including those set forth in the Colorado Bingo-Raffles Law Handbook, which includes Article XVIII, Section 2 of the Colorado Constitution, Title 24, Article 21, Part 6 of the Colorado Revised Statutes and the Code of Colorado Regulations - Rules Covering and Regulating Bingo and Raffle Games. The Raffle is subject to all laws, regulations and Acts of God that would render the drawing illegal, unreasonable or impractical; any changes will be made upon approval of the Colorado Secretary of State. Tickets may sell out before the date of the raffle drawing. The chances of winning are based on the number of tickets sold. If fewer tickets are sold, the chances of winning the Grand Prize and other prizes improve. Tickets purchased for the Raffle shall be void where prohibited by law and shall not be sold outside the United States.

C.      ELIGIBILITY.

1.       To be eligible to purchase a Raffle ticket, you must be at least 18 years old, and a resident of Colorado.

2.       The following persons and their immediate family members shall not be eligible to purchase a ticket: Officers, directors, and employees of NWSoCO.  

a.      For these purposes “immediate family members” is hereby defined to include any spouse, parent, brother, sister, child, grandparent, and/or grandchild.

b.      This eligibility prohibition further includes any individual: (i) for whom any officer, director, or employee of NWSoCO serves as their legal guardian; and/or (ii) who reside in the same house as any officer, director, or employee of NWSoCO or any immediate family member, whether they are related to such person or not.

3.       Any ticket purchased by an ineligible person as defined above shall be void and cannot be a winning ticket.

4.       Winning the prize is also contingent on satisfying all other requirements set forth herein, which shall be determined by NWSoCO at its sole and absolute discretion.

5.       NWSoCO reserves the right to verify the eligibility of winners and any determination it makes regarding same shall be final and binding.

D.     TICKETS.

1.       Raffle tickets may be purchased via the NeighborWorks Southern Colorado website at www.nwsoco.org. You must provide all required information to be eligible to enter and win. Incomplete, illegible, corrupted, or untimely entries are void and will be disqualified.

2.       Ticket sales will stop on Sunday, September 25, 2022, at 11:59pm

3.       Raffle tickets may be purchased for $100 each.

4.       Total number of raffle tickets available to be sold will be limited to 5,000. 

5.       Raffle tickets are limited to a maximum of 50 tickets per entity.

6.       Raffle tickets are limited to a maximum of 1 ticket per day, if an entity wishes to purchase 50 tickets in total, they must begin purchasing no later than 8/7/2022.

7.       A ticket represents a chance to win the opportunity to accept an offer of the stated prize.

8.       All sales of tickets are final, and no refunds will be paid.

9.       Raffle tickets, prizes, receipts, and any winner’s rights are not transferable.

10.   NWSoCO reserves the right to reject any Raffle ticket reservation request that is submitted with payment that does not constitute “good funds.” A ticket issued in exchange for a check returned for “insufficient funds,” or for a credit card charge that was “declined,” or reported as “invalid” or “stolen” is void and cannot be a winning ticket.

11.   Raffle tickets are not considered tax-deductible charitable contributions.

12.   All Raffle tickets must be purchased by the indicated deadline. Any orders received after these deadlines will be ineligible.

13.   NWSoCO cannot guarantee delivery for lost, late, misdirected, or non-delivered mail, undeliverable email or fax messages, or any other failure to receive orders prior to the drawing deadlines.

14.   NWSoCO will use its best efforts to deliver receipts to Raffle ticket purchasers. To inquire about the status of a ticket or receipt, please call 719-544-8078.

15.   In the event a purchaser misplaces or loses the ticket number assigned to the purchased ticket, the confirmation number from the purchase of the ticket may be used to verify the ticket number. We strongly urge all purchasers to retain their confirmation number directly after purchase. (i.e printing the receipt, writing down in a safe place)

E.      THE DRAWING / PRIZE.

1.       Drawing: NWSoCO will select the winning ticket at random on the date of the Raffle drawing from all eligible Raffle tickets. All tickets have an equal chance to win. Ticket purchasers need not be present to win.

2.       Raffle Prize: The winner shall receive NeighborWorks Southern Colorado’s Hyde Park Gardens Model House located in Pueblo, Colorado, with an estimated value of $360,000.00 (the “Prize”), which shall be delivered free and clear of any liens and encumbrances except for those specifically identified herein.

F.      WINNERS/ODDS.

1.       The winner shall receive the Prize (i.e., model home) through a General Warranty Deed and take ownership thereof subject to all applicable federal, state, and local land use restrictions, and to any covenants, rules, fees, easements of record or administered by a homeowners’ or condominium association, or other community.

2.       The odds of winning the Prize depends on the number of valid raffle tickets sold. A maximum of 5,000 tickets will be available for purchase. The chances of winning are based on the number of tickets sold. If fewer tickets are sold, the chances of winning the prize improve.

3.       The Prize will be awarded to only one (1) winner. If the ticket has more than one name on it, the Prize will be awarded to the eligible individual whose name appears first on the ticket. That individual is solely responsible for allocating the value of the Prize among the purchasers.

4.       NWSoCO[BG4]  will notify the winner by phone followed up in writing by sending a Winner Notification Agreement (“WNA”) by certified U.S. mail, return receipt requested to the mailing address provided by the purchaser within thirty (30) days of the drawing.  The WNA shall reaffirm the Prize won, a contact person’s telephone number, and the time and location where the Prize can be claimed.

5.       The winner agrees to accept the Prize, “as is,” by signing the WNA and returning it to NWSoCO within 30 days after the date the WNA is received.

6.       If the winner cannot be contacted by certified mail, fails to accept the Prize, or if the winner and their companion are unavailable to travel within any time period specified by NWSoCO, or if the winner is disqualified for any reason, the Prize is forfeited, and no substitute or alternative prize will be provided. A forfeited prize may be retained by NWSoCO and offered at another raffle.

7.       Acceptance of the Prize constitutes permission for NWSoCO to use the winner’s name, picture, video image, and relevant quotes to promote NWSoCO’s Home Raffle, and agreement by the winner that the Prize will not be used for fundraising for another charity. NWSoCO may substitute a prize of equal or greater value if the stated prize is not reasonably available.

8.       The winner shall have no rights in or to the Prize itself until: (a) they have been verified as eligible by NWSoCO; (b) they have timely executed the WNA and returned it to NWSoCO, and (c) delivery of the Prize has been completed. Until such conditions have been satisfied, as between NWSoCO and the winner, the Prize shall remain to be the sole property of NWSoCO.

9.       All potential winners are subject to verification by NWSoCO, whose decisions are final and binding in all matters related to the raffle. An entrant cannot win the Prize unless and until their eligibility has been verified and they have been notified that such verification has been completed.

G.     TAXES/PRIZE RESTRICTIONS.

1.       All applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of the Prize not specifically stated herein, including but not limited to, financing charges, change of air travel fees, ground transportation, automobile insurance, meals, incidentals, passenger tariffs or duties, surcharges, service charges or facility charges, personal charges at lodging, security fees and/or other expenses, are the sole responsibility of the winner.

2.       The Prize cannot be substituted, assigned, transferred, or redeemed for cash; however, NWSoCO reserves the right to make equivalent prize substitutions at its sole discretion. The Prize cannot be used in conjunction with any other promotion or offer.

3.       The winner is solely responsible for payment of all federal, state, and/or local income, sales, or use taxes due on account of their acceptance of the Prize.  The winner further assumes all other fees, local, state and federal taxes, including but not limited to income taxes based on the value of the Prize/home, closing costs, title insurance, and transfer tax and fees, which must be paid when the Prize/home is transferred to the winner.

4.       The value the Prize is includable in the winner’s gross income and may be subject to reporting by NWSoCO to the Internal Revenue Service (IRS). Since the Prize has a value of more than $5,000, the IRS could require NWSoCO to withhold federal income tax at the rate of 24%, or current rate as established by the IRS, and state tax. The winner must pay the amount of tax to be withheld to NWSoCO as a condition of transfer of ownership of the Prize. NWSoCO take no responsibility for any tax liabilities.

5.       The winner of the NeighborWorks Southern Colorado Home Raffle agrees that the value of the Prize property reported by NWSoCO for income tax and other purposes will be based on the written appraisal obtained from a licensed appraiser. 

6.       NWSoCO does not guarantee that any winner who receives the Prize/home will be able to sell it for the appraisal value or that the IRS will use that value in its tax calculations.

7.       The winner is advised to consult a tax professional before returning the WNA and accepting the Prize.

H.     GENERAL PROVISIONS.

1.       In no event shall NWSoCO be liable to any person for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or, consequential, or other damages of any person or entity whether arising in contract, tort or otherwise, arising from the sale of Raffle tickets, the Prize awarded, other act or omission arising from or related to the Raffle, use or ownership of the Prize.

2.       Each winner hereby agrees to release and hold NWSoCO harmless from any claim or demand based upon or in any way related to the Raffle.

3.       Each Raffle entrant’s sole and exclusive remedy for any act or omission related to the Raffle shall be limited to the return of the purchase price paid for their Raffle ticket(s).  

4.       If, for any reason, the Raffle is not capable of running as planned, including any causes beyond the control of NWSoCO which corrupt or affect the operation, administration, security, fairness, integrity, or proper conduct of this Raffle, NWSoCO may, after consulting with the Colorado Secretary of State’s Office, and in its sole discretion, void any suspect entries and: (a) cancel or terminate the Raffle; (b) issue refunds; (c) modify or suspend the Raffle to address the impairment and then resume the Raffle in a manner that best conforms to the spirit of these Official Rules; and/or (d) award the Prize from among the eligible, non-suspect entries received up to the time of impairment.
